Development Appeal Committee

Role of Committee

  • To confirm, revoke or vary the order of the Development Officer regarding development permits and/or any condition attached to them
  • To hear all appeals from the Development Authority

Membership

  • Three (3) representatives from Council and four (4) Members at Large
  • A per diem and mileage is paid

Term/Expiry

  • Three (3) Council reps for a one (1) year term
  • Four (4) Members at Large for a one (1) year term

  • Approximately seventeen (17) three hour meetings every year at the call of the Chair

How to File an Appeal

  • You can appeal a Development Officer’s decision if:
    • Your application for a development permit has been refused
    • Your application for a development permit was approved with conditions unacceptable to you
    • You have been issued an Order directing you to stop construction or stop the present use of your property
    • You will be affected by a new development, or new use of someone else’s development
    • If a development authority refused or fails to issue a development permit within 40 days of receipt of the application
  • Prior to filing an Appeal to the Development Appeal Committee, talk to your neighbours and consult with the Development Officer to ensure that you have all the information required to make a proper appeal.
  • An appeal form must be filed in accordance with the Municipal Government Act and must meet the following three requirements:
    1. The Appeal must be completed on the Development Appeal form.
    2. The Appeal must be received by the Legislative Services Manager, "Secretary to the Subdivision and Development Appeal Board "within 14 days of the date of decision by the Development Authority.
    3. The Development Appeal must be accompanied by the applicable fee as per the Master Rates Bylaw: $250.00 if you are an affected party, appealing the decision of the Development Authority, $350.00 if you are the owner, appealing the decision of the Development Authority and $500.00 if you are appealing an Order of the Development Officer.
  • If an appeal is filed and subsequently withdrawn prior to the Hearing start, there is no appeal.
  • Appeal forms cannot be submitted through email or online. They must be mailed or delivered to:

Overview of the Appeal Process

  • All Development Permits issued by the Development Officer are advertised in the Rocky View Weekly. An Appeal must be filed within 14 days of the date of the decision of the Development Officer.
  • All appeals received will be scheduled for a hearing within 30 days. Development Appeals are advertised in the Rocky View Weekly at least 8 days prior to the hearing. The Appellant, and Applicant, if different, along with adjacent landowners, and anyone that the Board considers to be affected by the Appeal, will receive notification of the hearing date, time and appeal hearing procedures.
  • Persons wishing to present written material to the Committee and have it included in the Agenda, should submit the material to the Secretary of the Development Appeal Committee at least 10 days prior to the Hearing; or
  • If you wish to submit written evidence at the hearing, you must provide 12 copies to be distributed at the time of your presentation.
  • A copy of the hearing agenda and reports for any item can be picked up at the County office the day of the hearing.
  • Please Note: All materials submitted at the hearing become part of the public record of the Development Appeal Committee and can be released to the public.
